{"id":5739,"date":"2025-12-30T18:18:50","date_gmt":"2025-12-30T18:18:50","guid":{"rendered":"https:\/\/www.awjlaw.com\/?p=5739"},"modified":"2026-02-04T23:35:26","modified_gmt":"2026-02-04T23:35:26","slug":"9-million-dollar-kia-and-hyundai-lawsuit-settles","status":"publish","type":"post","link":"https:\/\/www.awjlaw.com\/blog\/9-million-dollar-kia-and-hyundai-lawsuit-settles\/","title":{"rendered":"$9 Million Kia and Hyundai Theft Lawsuit Settles"},"content":{"rendered":"<p>Thirty-six state attorneys general, including Georgia&#8217;s, have reached a $9 million multistate settlement with Hyundai and Kia over the sale of millions of <a href=\"https:\/\/www.awjlaw.com\/blog\/category\/automobile-recall\/\">defective vehicles<\/a> between the years 2011 and 2022.\u00a0 Investigators found that these vehicles lacked engine immobilizers, which are a standard anti-theft feature that prevents the engine from starting without the presence of the vehicle\u2019s \u201csmart key.\u201d<\/p>\n<p>This lack of an immobilizer left Kia and Hyundai models vulnerable to theft. This issue then led to a widely known \u201cKia Challenge,\u201d a viral, dangerous TikTok trend that highlighted the major security flaw in these models. Videos would show how easy the vehicles were to steal by breaking the steering column and using a USB cable or screwdriver as a makeshift key.<\/p>\n<p>Because of this simple method, you saw a variety of thieves, from online teenagers, unlicensed drivers, and seasoned criminals stealing the affected cars. These drivers may not fully understand traffic laws or safe driving practices, increasing the <a href=\"https:\/\/www.awjlaw.com\/blog\/category\/auto-accidents\/\">risk of crashes<\/a>, especially when they&#8217;re attempting to evade the law. Leading to a widespread and dangerous phenomenon.<\/p>\n<h2>WHAT WILL HAPPEN IN THE HYUNDAI AND KIA SETTLEMENT?<\/h2>\n<p>Under the terms of the agreement from the settlement, Hyundai and Kia must:<\/p>\n<ul>\n<li>Equip future vehicles sold in the U.S. with industry-standard engine immobilizer anti-theft technology.<\/li>\n<li>Offer free zinc-reinforced ignition cylinder protectors to people who own or lease any eligible vehicles.\n<ul>\n<li>This includes vehicles that previously were only eligible for the company\u2019s software updates.<\/li>\n<\/ul>\n<\/li>\n<li>Pay $4.5 million to eligible customers whose vehicles were found damaged by thieves.\n<ul>\n<li>This includes customers who still had their cars stolen on or after April 29th after downloading the provided software updates.<\/li>\n<\/ul>\n<\/li>\n<li>Pay $4.5 million to the states involved in the settlement for the costs of the investigation.<\/li>\n<\/ul>\n<h2>HOW MAY I RECEIVE HELP FOR MY AFFECTED HYUNDAI OR KIA?<\/h2>\n<p>Hyundai and Kia state that they will &#8220;<em>offer free hardware fix for all affected vehicles that will thwart further thefts and protect public safety<\/em>,&#8221; according to a <a href=\"https:\/\/consumer.georgia.gov\/press-releases\/2025-12-16\/carr-announces-multistate-settlement-hyundai-and-kia-their-sales-vehicles\" target=\"_blank\" rel=\"noopener\">release from the Georgia attorney general<\/a>. Any eligible consumers will be notified by the companies that they have one year from the date of the notice to make an appointment to have their zinc-reinforced ignition cylinder protector installed at their local Hyundai or Kia authorized dealerships<\/p>\n<p>Hyundai and Kia owners can check if their make and model is eligible for benefits\u00a0<a href=\"https:\/\/www.hkmultistateimmobilizersettlement.com\/\" target=\"_blank\" rel=\"nofollow noopener\">here<\/a>. Customers can expect to possibly receive up to $4,500 for a total vehicle loss or up to $2,250 for a partial loss, if their vehicle falls under a &#8220;<a href=\"https:\/\/www.hkmultistateimmobilizersettlement.com\/#:~:text=vehicle%20experienced%20a-,Qualifying%20Theft%20or%20Qualifying%20Theft%20Attempt,-%2C%20you%20may%20receive\" target=\"_blank\" rel=\"noopener\">Qualifying Theft or Qualifying Theft Attempt.<\/a>&#8221; To file, Hyundai drivers can do so online at <a href=\"https:\/\/www.hkmultistateimmobilizersettlement.com\/\" target=\"_blank\" rel=\"noopener\">HKMultistateimmobilizersettlement.com<\/a>,\u00a0and Kia users can do so online at\u00a0<a href=\"https:\/\/customercare.kiausa.com\/SWLD\" target=\"_blank\" rel=\"noopener\">customercare.kiausa.com\/SWLD<\/a> or by phone at 1(800) 333-4542.
