This is a time-old saying that still goes unheeded: &#8220;Don&#8217;t Text and Drive.&#8221; <a href=\"https:\/\/www.awjlaw.com\/blog\/category\/distracted-driving\/\">Distracted driving<\/a> is deadly.<\/p>\n<p><strong>In 2023 alone, 3,275 people were killed as a result of distracted driving.<\/strong>\u00a0However, this statistic may not be accurate, as it&#8217;s important to note that cell phone-related crashes are <em>vastly under-reported<\/em> (NSC); there is currently no specific way to measure if someone had been texting before the <a href=\"https:\/\/www.awjlaw.com\/blog\/category\/car-accident\/\">accident<\/a>. That fact alone could account for tens of thousands more cases we aren&#8217;t made aware of.<\/p>\n<p>At Jones &amp; Swanson, one of our missions is to ensure public safety above all else. We understand how tempting it can be, and want people to know that instead of waiting till you&#8217;re accounted for that growing statistic, there are things you can do and should know that could prevent the urge.<\/p>\n<h2>The Law about Distracted Driving.<\/h2>\n<p>This is not new; texting and driving has been a growing issue in our nation for the past decade. In July of 2018, the Georgia Hands-Free Act was put in place to help prevent distracted driving.<\/p>\n<p>Georgia Law states that &#8220;<em style=\"font-size: 19px;\">A driver cannot have a phone in their hand or use any part of their body to support their phone.<\/em>\u00a0 Drivers can only use their phones to make or receive phone calls by using speakerphone, earpiece, wireless headphone, in-vehicle hands-free audio system, or an electronic watch.\u00a0 GPS navigation devices are allowed.&#8221; (<a style=\"font-size: 19px;\" href=\"https:\/\/dps.georgia.gov\/press-releases\/2018-06-01\/are-you-ready-hands-free-georgia#:~:text=A%20driver%20cannot,devices%20are%20allowed.\" target=\"_blank\" rel=\"noopener\">DPS)<\/a><\/p>\n<p>While there are exceptions to this rule for reporting emergencies and hazards, the consensus is to keep your hands off the phone and focus on the road.<\/p>\n<ul>\n<li>For a first conviction of distracted driving in the state of Georgia, there will be a fine of no more than $50.00 and 1 point on your license.<\/li>\n<li>For a second conviction within 24 months, the fine will be no more than $100.00 and 2 points on your license.<\/li>\n<li>If you are found breaking this law for a third time within 24 months after your second conviction, you will have a fine of no more than $150.00 and 3 points on your license.<\/li>\n<\/ul>\n<p>It takes an accumulation of 15 points within 24 months to have your license suspended in the State of Georgia. You may also see a hike in your insurance rates after receiving a ticket for distracted driving. The average rate increase is 23%, but it may be higher or lower depending on the situation, especially if you cause an accident.<\/p>\n<h2>What can I do about Distracted driving?<\/h2>\n<h5><strong>Pull Over.<\/strong><\/h5>\n<ul>\n<li>If you truly cannot avoid it, due to an emergency, urgency, or anything else, pull over, find a safe spot to stop, and fully park the car. Do not sit on your brakes at a stoplight answering a text.<\/li>\n<\/ul>\n<h5><strong>Designate a Texter.<\/strong><\/h5>\n<ul>\n<li>If you have a passenger in the car, let them take control of responding to friends, work, and family. They can handle it while you focus on the road.<\/li>\n<\/ul>\n<h5><strong>Utilize Hands-free equipment.<\/strong><\/h5>\n<ul>\n<li>Thankfully, we live in the age of technology when most cars are equipped with Bluetooth, CarPlay, and Android Auto connections to radios. If you have an older model car, typically there will be a wired connection, and if unavailable entirely, try to purchase a Bluetooth headset instead.<\/li>\n<\/ul>\n<h5><strong>Silence Your Phone.<\/strong><\/h5>\n<ul>\n<li>One of the easiest tips is to simply silence your notifications or shut off your phone; this alone is the simplest way to resist the urge each time you drive.<\/li>\n<\/ul>\n<h5><strong>Put It On Do Not Disturb.<\/strong><\/h5>\n<ul>\n<li>If you need to use a directional app, it is recommended to use &#8220;Do Not Disturb.&#8221; This is an option available on both iPhone and Android.<\/li>\n<\/ul>\n<h5 style=\"text-align: left;\"><strong><i style=\"font-weight: normal;\">For iPhone Users:<\/i><\/strong><\/h5>\n<ol style=\"text-align: left;\">\n<li>\u00a0Swipe down on your home screen.<\/li>\n<li>Tap the focus button where a crescent moon icon appears.\n<ol>\n<li>You can also ask Siri to turn Do Not Disturb on or off.<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n<p style=\"text-align: left;\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.awjlaw.com\/wp-content\/uploads\/2023\/10\/Screenshot-2023-10-20-161937.png\" sizes=\"auto, (max-width: 376px) 100vw, 376px\" srcset=\"https:\/\/www.awjlaw.com\/wp-content\/uploads\/2023\/10\/Screenshot-2023-10-20-161937.png 376w, https:\/\/www.awjlaw.com\/wp-content\/uploads\/2023\/10\/Screenshot-2023-10-20-161937-171x300.png 171w\" alt=\"iPhone do not disturb\" width=\"376\" height=\"658\" \/><\/p>\n<h5 style=\"text-align: left;\"><i>For Android Users(May not be universal):<\/i><\/h5>\n<ol style=\"text-align: right;\">\n<li style=\"text-align: left;\">\u00a0Swipe down from the top of the screen twice.<\/li>\n<li style=\"text-align: left;\">Tap the &#8220;Do Not Disturb&#8221; tile to turn it on.<\/li>\n<li style=\"text-align: left;\">Long-press for a larger range of Do Not Disturb options.<\/li>\n<\/ol>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone\" src=\"https:\/\/www.awjlaw.com\/wp-content\/uploads\/2023\/10\/Screenshot-2023-10-20-164326.png\" sizes=\"auto, (max-width: 347px) 100vw, 347px\" srcset=\"https:\/\/www.awjlaw.com\/wp-content\/uploads\/2023\/10\/Screenshot-2023-10-20-164326.png 347w, https:\/\/www.awjlaw.com\/wp-content\/uploads\/2023\/10\/Screenshot-2023-10-20-164326-138x300.png 138w\" alt=\"Android Do Not Disturb\" width=\"261\" height=\"569\" \/><\/p>\n<h5><em>Educate Your Friends and Family.<\/em><\/h5>\n<ul>\n<li>Many will understand if you let them know you&#8217;re committed to safe driving. A simple &#8220;Hey, I&#8217;m about to drive, I&#8217;ll message after.&#8221; is all that&#8217;s needed. This way, they will understand if you don&#8217;t reply right away.<\/li>\n<\/ul>\n<h5><em>Set Reminders.<\/em><\/h5>\n<ul>\n<li>If you know you&#8217;re on a set schedule for work or school, maybe set a reminder to reinforce the importance of not texting. Regular nudges are a great way to help prevent the urge.<\/li>\n<\/ul>\n<h5><em>Utilize Auto-Responses.<\/em><\/h5>\n<ul>\n<li>Many phones currently provide the option to use auto-responses, and when a call is missed, you can simply create a response that says for you, &#8220;Sorry, I&#8217;m driving!&#8221;<\/li>\n<\/ul>\n<h5><strong>\u00a0<i style=\"font-weight: normal;\">For iPhone Users:<\/i><\/strong><\/h5>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>Luckily for iPhone users, the phone provides an app named Focus, and it can help you set up a &#8216;Driving Focus&#8217; sequence. The law does not state this specifically, as it says you may use it in place of a phone.
