{"id":1887,"date":"2017-01-11T00:00:00","date_gmt":"2017-01-11T00:00:00","guid":{"rendered":"https:\/\/www.awjlaw.com\/2017\/01\/11\/what-not-to-do-after-a-car-wreck\/"},"modified":"2024-10-23T09:21:25","modified_gmt":"2024-10-23T09:21:25","slug":"what-not-to-do-after-a-car-wreck","status":"publish","type":"page","link":"https:\/\/www.awjlaw.com\/faqs\/what-not-to-do-after-a-car-wreck\/","title":{"rendered":"What Not to Do After a Car Wreck"},"content":{"rendered":"<p>According to the most recent data released by the National Highway Traffic Safety Administration (NHTSA), in 2015, there were nearly 6,300,000 non-fatal crashes in the United States, and 1,715,000 injury accidents \u2013 that\u2019s a LOT.<\/p>\n<p>It\u2019s a known fact among scientists and researchers: your chances of being in at least one <a href=\"https:\/\/www.awjlaw.com\/marietta\/car-accident-lawyer\/\">car wreck<\/a> during your lifetime are very high, and significantly higher than your chances of being in an airplane crash.<\/p>\n<p>With the above in mind, it\u2019s important for all drivers to understand how to conduct themselves in the event of a crash, because if they say and do the wrong thing, it can negatively affect their <a href=\"https:\/\/www.awjlaw.com\/\">personal injury <\/a> case, as well as many aspects of their life.<\/p>\n<p>Just think, if you\u2019re in an accident and you automatically admit fault (when it wasn\u2019t your fault), and your admissions lead to a greatly reduced settlement, how would that affect your family\u2019s finances? It\u2019s mistakes like this that can have long-lasting consequences.<\/p>\n<p><strong>What not to say and do if you\u2019re ever in a car accident: <\/strong><\/p>\n<ul>\n<li><strong><em>Never admit fault.<\/em><\/strong> Even if you think you\u2019re at fault, it doesn\u2019t mean you are. You must resist the urge to say, \u201cI\u2019m so sorry, it\u2019s all my fault!\u201d If you admit fault, even if you aren\u2019t, the insurance company will use your statement to try and reduce the policyholder\u2019s (the other driver) responsibility and in effect, the amount of your settlement. Whatever you do, don\u2019t admit fault, instead leave it to the insurance companies to figure out.<\/li>\n<li><strong><em>Do not speed away from the scene<\/em><\/strong><em>. <\/em>We get it, car wrecks can be nerve-wracking events that send your adrenaline rushing and your heart racing, but you must fight the natural \u201cflight or fight\u201d response. If you flee the scene of an accident, even if you aren\u2019t at fault, you could face criminal charges for hit and run. Remember, by law, you are legally required to stop and check to see if anyone was hurt and call an ambulance if one is needed. You are also supposed to remain at the scene and exchange information with the other driver(s).<\/li>\n<li><strong><em>Don\u2019t forget to call the police.<\/em><\/strong> Police reports are important; don\u2019t exchange information with the other driver and fail to call the police. If the other driver is clearly at-fault, the police may ticket him or her for \u201crunning a red light\u201d or \u201cfailing to yield the right of way.\u201d If the police issue the other driver a ticket for violating a traffic law, it will help your case and speed up the claims process. Always call the police so they can write a police report.<\/li>\n<li><strong><em>Don\u2019t lie if you\u2019re on something.<\/em><\/strong> If you were under the influence of a prescription medication at the time of the crash, don\u2019t lie about it. Drivers can be subjected to chemical tests after an accident so there is no point in lying if you\u2019re on something.
